This Member Agreement ("Agreement") is entered into voluntarily between the undersigned member ("Member") and Levaterra Foundation ("Association"), a Private Member Association (PMA) operating under an Unincorporated Association model.

Levaterra Foundation oversees and operates the following entities under its private domain: Malan Realty, ThoughtCrafts, HearthVision, Malan Educational Association, Backwoods Label, CyMatrIX, and Malan Music. These entities function exclusively within the PMA structure, ensuring that all interactions remain private and protected under the Association's framework.

ilumWeave and its property lead outlets operate within this Association. Creating a platform account and using our website, products, or services constitutes voluntary membership in Levaterra Foundation under the terms below.

Agreement to private membership

The Member acknowledges that Levaterra Foundation is a Private Member Association and that all interactions, transactions, and activities within the Association are private and not subject to public law, government regulation, or statutory oversight. The Member joins voluntarily and understands that participation in the Association is based on private contract law rather than statutory law.

Member rights and responsibilities

The Member has the right to associate, transact, and participate in activities within the private domain of the Association. The Member agrees to conduct themselves in alignment with the purpose, mission, and values of Levaterra Foundation, which include principles of self-governance, freedom, privacy, and personal responsibility. The Member acknowledges that any disagreements or disputes must be resolved internally within the Association.

Confidentiality, privacy, and non-disclosure

The Member agrees to maintain strict confidentiality regarding the operations, discussions, and activities of the Association. The Member shall not disclose, share, or distribute any proprietary or sensitive information related to the Association without express permission. The Member acknowledges that Levaterra Foundation is a private organization and that any information, documents, communications, or business dealings conducted within the Association are strictly private. The Member further agrees that they will not invite government agencies, media outlets, or any other external authorities to interfere in Association matters.

The Member understands that any proprietary methods, trade secrets, business strategies, and internal resources shared within the Association are privileged information, and they are prohibited from using or sharing such information outside of the Association. Any violation of this confidentiality agreement may result in immediate termination of membership and potential legal action.

Indemnification and hold harmless

The Member agrees to indemnify and hold harmless Levaterra Foundation, its leadership, and all other members from any claims, liabilities, losses, damages, or legal actions arising from their voluntary participation in the Association. The Member acknowledges that all activities are entered into voluntarily and at their own discretion. The Association, its leadership, and fellow members shall not be held liable for any outcomes resulting from membership participation, including but not limited to financial, personal, legal, or health-related decisions made by the Member.

The Member agrees that any services, information, or guidance provided within the Association are for private use only and do not constitute public legal, medical, or financial advice. By agreeing to this Agreement, the Member waives all rights to pursue legal claims against the Association or its representatives for any reason related to their membership.

The Member further acknowledges that they assume full responsibility for their own actions and decisions while participating in the Association. The Association makes no guarantees or warranties regarding outcomes of participation, services, or recommendations provided within the private domain.

Dispute resolution and private arbitration

The Member agrees that any dispute arising within the Association shall be resolved exclusively through private mediation or arbitration. The Member waives any right to bring claims, disputes, or grievances before public courts or government authorities and instead agrees to resolve all matters internally in accordance with the Association's policies.

If any dispute cannot be resolved through informal mediation, both parties agree to submit the matter to binding arbitration under a mutually agreed-upon private arbitrator. The arbitration shall be conducted in accordance with private arbitration procedures, and the decision of the arbitrator shall be final and legally binding. The Member further agrees that any legal disputes will not be made public or disclosed outside the private arbitration process.

The Member acknowledges that by agreeing to this clause, they forfeit their right to sue the Association, its leadership, or its members in any public forum, including but not limited to local, state, or federal courts. Any attempt to bypass this arbitration agreement shall be considered a violation of membership terms and may result in immediate termination of membership.

Financial contributions

The Member acknowledges membership in Levaterra Foundation is free, but payment may be required for accessing any products or services from any companies which are a part of the Association. The Member agrees that all payments are private transactions within the Association and are non-refundable.

Autonomy in health, medicine, and personal choices

The Member acknowledges their right to make autonomous decisions regarding their health, wellness, and lifestyle. The Association does not impose any mandates or restrictions on medical, holistic, or alternative treatments. The Member is solely responsible for their own choices and waives any claim against the Association regarding such matters. The Association also recognizes the rights of members to use controlled substances such as marijuana, CBD, peyote, psilocybin, and other natural remedies for spiritual or healing purposes, provided they are used responsibly and not for recreational abuse.

Religious and philosophical freedom

The Member acknowledges their right to believe and practice their faith or philosophy freely. No religious doctrine is imposed upon any member, and all members agree to respect the diverse beliefs and practices within the Association.

Membership termination

Membership in the Association is a privilege, not a right. The Association reserves the authority to terminate the membership of any individual who engages in behavior that is disruptive, dishonest, harmful to the integrity of the Association, or in direct conflict with its mission. Membership may also be revoked if a member invites government interference into the Association's private affairs.

Acknowledgment and agreement

By accessing and using this website, products, or services, the Member acknowledges that they have read, understood, and voluntarily agreed to the terms of this Membership Agreement. The Member affirms that their participation in the Association is of their own free will and that they accept full responsibility for their engagement.
